This week we’re looking at the looming gig economy legal battle coming to Massachusetts.

 

What’s Happening?

Last year, California was ground zero for the “are app-based workers employees or independent contractors?” battle. After the most expensive political push in CA history, voters chose the latter. Now, this question is being raised in MA.

 

Uber, Lyft, and other app companies are pushing a bill in the MA legislature that would cement their workers as independent contractors while setting up a “portable benefits account,” a type of half-measure that falls shy of full benefits.

 

The Coalition to Protect Workers’ Rights, a civil rights and union group, is pushing back, saying the PBAs are inadequate.

Why Does it Matter?

If app workers (Uber drivers, Doordash deliverers, etc. etc.) are classified as “employees” then they’re entitled to benefits like health insurance and paid time off. If they’re “independent contractors” then they are not. 

 

Without benefits, app workers, who are disproportionately black and brown, find it increasingly hard to make ends meet and earn enough for vacation.

 

On the other hand, the app companies say becoming employees will strip workers of the “work when you want” flexibility. Some workers are sympathetic to this point, though it’s unclear how this would manifest, given it would require a massive restructuring for app-based companies.

 

“Do not be fooled, folks. The model big tech brought to California and [is] now attempting to bring to Massachusetts does nothing more than to allow [tech companies] to skirt the laws.” Steven Tolman, president of the Massachusetts AFL-CIO.
